Terex-Demag and Liebherr Reach Patent Infringement Agreement
May 25, 2005 — Terex-Demag GmbH & Co. KG and Liebherr-Werk Ehingen
GmbH have reached a settlement regarding the pending patent and civil law actions in Germany and the United States over alleged infringement of Terex Demag's Sideways Superlift patents by the Liebherr Y-Guy boom support system. The agreement comes more than a year after the dispute came to a head in April 2004. This dispute concerned technologies of the lateral suspension of the telescopic booms as well as the assembly of the counterweights of mobile and crawler cranes. According to Terex, both companies have ended all litigation and agreed to grant each other worldwide mutual rights of use of the concerned intellectual property rights.
